Divorce does not have to mean property division disaster

When a California couple decides to end their marriage, many fear that the process of bringing the matter to a close will result in financial disaster. Virtually everyone knows someone who went through a lengthy, bitter and expensive divorce, and many spouses fear that they will sustain serious monetary losses when they choose to end their own union. However, it is important to realize that many of the negative repercussions of a divorce and property division can be mitigated or eliminated with the right mix of planning and careful action.

One risk that many spouses face involved allowing their emotions to rule their decision-making process. This can take a variety of forms; some spouses become so angry that they cannot think clearly, while others feel significant guilt, and give away far more in the divorce than is wise. Regardless of how the marriage came to an end, the decisions made during a divorce should be focused on attaining a fair division of marital assets, and enabling both parties to move forward with a degree of financial security.

Another common mistake involves taking legal advice from those who are not qualified to give it. One’s friends, family and hairdresser may be a valuable source of emotional support, but these are not the places to look for legal advice. The best course of action is to hire a divorce attorney who can be trusted to look after one’s interests and move the process forward. Once that decision has been made, it is imperative to take advantage of one’s legal counsel and follow his or her advice and guidance.

By moving through the California property division process carefully and with an eye toward the future, it is possible to emerge from divorce with a positive financial scenario and the ability to build a new life for oneself. Avoiding common pitfalls that can derail the process and lead to financial losses is an important priority, and one that should not be taken lightly. As with any significant risk, understanding the ways that one can negatively influence the process is key to moving forward successfully.
