Changes to child support calculations in California

On Behalf of Cullen Family Law Group | Dec 10, 2024 | Child Support |

California passed SB 343 on September 1, 2024, significantly changing child support calculations. This new law aims to make child support fairer and more aligned with some parents’ financial capacity today. California residents should know how these changes might affect them.

Key changes

SB 343 brings several significant changes to child support calculations:

  1. The law raises the income limit for low-income adjustments, allowing parents to pay less child support if their income is below a certain amount.
  2. Courts can now look at how much a parent could earn, not just what they do earn. If a parent works less than they could or chooses not to work, the court can base child support on what they could make.
  3. The new law provides more precise rules for changing child support based on how much time each parent spends with the child. This ensures that support amounts are fair and match parenting time.

These changes create a more balanced approach to child support, taking into account parents’ different financial situations.

What this means for you

SB 343 could affect you if you now pay or get child support or if you think you might have a child support case. Think about these things:

  1. Review your current child support plans with these new rules. You might need to make changes to accommodate the new law.
  2. Talk to a lawyer to understand how SB 343 applies to you since child support math can be tricky.
  3. Follow any new updates or explanations about SB 343 to ensure that you follow the law and understand it.

SB 343 marks a significant change in how California handles child support, aiming to be fair and fit each family’s needs. Knowing these changes will help you handle the child support system and ensure your plans are fair and proper.
