How can you document SP for asset protection?

When you’re about to get married, it’s important to think about how to protect your assets, including spousal support (SP) money. If you’ve received spousal support in the past or expect it during your marriage, you may worry about documenting its use—especially if you plan to use it for significant purchases like a home. Properly documenting your SP money will protect it from mixing with joint or community property.

How to track spousal support money

To protect your spousal support funds, start by keeping clear and organized records. Open a separate account for your SP payments and deposit them directly into that account. Doing this prevents the money from mixing with your marital or community property. Save all payment records, whether in electronic or paper format, such as checks or direct deposit notifications. These records will help you prove that the funds you use are from spousal support.

What documents to save

Keep all documents related to your spousal support payments and how you use the funds. This includes bank statements showing SP deposits, copies of checks or direct deposit notifications, and any formal agreements related to your spousal support. If you use the SP for significant purchases, like a home down payment, document these transactions as well. Save receipts, bank transfers, and written communication that shows the funds were used for the purchase.

How to prove SP was used for a home down payment

Proving that SP went toward a home down payment helps keep the funds classified as separate property. The best way to document this is by keeping a detailed paper trail. For example, if you transferred SP money from your separate account to a joint account for the home purchase, show that those funds came from your SP.

Keep a copy of the contract or agreement for the home purchase, along with bank statements that clearly show the transaction. If possible, note the down payment or specific SP contributions in the closing documents for the home. This documentation will prove that the funds remain separate from marital assets.

Documenting spousal support funds properly will protect your assets. By keeping organized records and clear proof of how you use SP money, you can avoid confusion or disputes later.
