On Behalf of | Jan 1, 2024 | Same-Sex Couples & Divorce |

While same-sex marriages have not been legal as long as heterosexual marriages, both unions can end in divorce. Despite this similarity, same-sex marriages do not encounter all the same issues during a dissolution. This does not make them any less emotional and complicated; however, it does mean that there might be additional or different steps in the process.

Same-sex divorce

At Cullen Family Law Group, our legal team understands that divorce is not an easy process; however, it is one you want to dedicate your time and energy to because the results of your divorce could impact your post-divorce life significantly. This is why our legal experts take the time to listen to our clients so we can support you the best way possible.

A same-sex divorce follows the same process as a heterosexual divorce. This means that they will go through the same divorce issues such as property division, child custody of biological or adopted children, child support, alimony and thanks to recent changes to federal law, Social Security benefits, military pensions and other government benefit programs.

How they differentiate

The only true way they differentiate is the tax implications that could arise in a same-sex divorce. Otherwise, there is no difference in the application of the law in a same-sex divorce. What causes the difference is how spouses of a same-sex couple are treated in the legal setting. Our law firm understands this, which is why we have a legal team dedicated to and experienced with same-sex family law.

Whether you seek to move forward with a same-sex divorce or a domestic partnership dissolution, it is important that you have an understanding of your rights and options. A legal professional can guide you through the process and support you through any challenges.
