With the exception of some tax implications, same-sex divorce is the same as the divorce between heterosexual spouses. Divorcing same-sex individuals have the same rights to marital property, responsibilities toward marital debts, rights to and obligations toward biological or adopted children, and potential eligibility to spousal support as do divorcing heterosexual individuals. Thanks to recent changes to federal law, even Social Security benefits, military pensions, and other government benefits programs are handled identically in same-sex and heterosexual divorces.
