New Year, New Start: When Should You Consider Divorce or Legal Separation?

by Cullen Family Law Group | Jan 4, 2026 | Divorce |

As the holiday season winds down, many couples in California begin to reflect on the state of their relationships. For some, the new year brings clarity—and a desire for a fresh start. But how do you know whether it’s time to consider divorce or legal separation?

Signs it may be time to separate

While every relationship is unique, certain patterns may indicate that a legal break could be the right next step:

  • Chronic conflict or resentment that counseling hasn’t resolved

  • Emotional or physical distance that feels permanent

  • Lack of trust, often due to infidelity or dishonesty

  • Disagreements about core values, parenting, or life direction

  • Domestic violence or controlling behavior

One Riverside client shared that after years of silent tension and failed therapy, she knew by January it was time to reclaim her peace—and legal separation helped her do that safely and gradually.

Divorce vs. legal separation in California

Both divorce and legal separation offer a legal framework to divide assets, establish support, and set custody arrangements—but they are not the same:

  • Divorce ends the marriage entirely

  • Legal separation allows couples to live separately while staying legally married

Couples may choose legal separation for:

  • Religious or personal reasons

  • Continuing health insurance coverage

  • Time to see if reconciliation is possible

Importantly, legal separation in California requires the same legal process as divorce, including petitions, financial disclosures, and potential court hearings.

Explore our guide to legal separation for more details.

Steps to begin the process

If you’re considering a split this new year, here are your first steps:

  1. Reflect on your goals: Do you want space, or do you want to move on?

  2. Consult a family law attorney: Learn your rights and options under California law

  3. Gather financial information: Assets, debts, income, and expenses

  4. Consider temporary orders: For custody, support, or safety

  5. File the appropriate petition: Whether for divorce or legal separation

FAQ: Legal separation and divorce

Q: Can I change a legal separation into a divorce later?
A: Yes. You can amend your petition or file a new one for divorce at any time.

Q: Do I need to go to court?
A: Not always. Many cases resolve through settlement agreements outside court.

Q: What if my spouse doesn’t agree?
A: You can still file and move forward even without mutual consent.
